CCES to Contest Decision by SC High School League to Sideline Thousands of Student-Athletes

Statement from Dr. Leonard Kupersmith, Head of School

With the three other non public schools in the State High School League, CCES brought suit on Monday, May 18 against recently passed amendments to the League’s By-Laws that we believe illegally and unjustly restrict parental school choice and access to athletic opportunities for students who choose to enroll at our schools. These amendments passed by the League in March would deny eligibility to participate in interscholastic athletics for a full year for virtually every student transferring to our schools after the beginning of the seventh grade. Our schools enjoy a high percentage of student participation in athletics. It is one of the most effective ways by which students integrate themselves into their new school communities. On the heels of the isolation imposed by Covid-19, restricting access to participation in athletics is particularly cruel and unjust.
 
Current South Carolina law ensures that non public-schools have equal right and privileges as the public schools. We believe that these amendments violate this law as well as other statutes, and in April the Attorney General issued an opinion agreeing with our position. The suit seeks to block enactment of these amendments for the upcoming school year.
 
Prior to the adoption of these amendments, students were able to transfer to schools within their district without loss of athletic eligibility.
